Terms of Service

This page is the short version of how we work with hotels and resorts. It covers who you're dealing with, what we sell, what you own, and what happens if you stop. When you buy from us, you get a quote and a service agreement that carry the full detail. Ask us for the agreement before you pay anything and we'll send it. Where this page and that agreement differ, the agreement is the one that counts.

1. Who you're contracting with

Designblue Philippines Inc., a registered Philippine company with its office in Salcedo Village, Makati City. We've been building brands, websites and marketing systems for Philippine companies since 2007.

BlueFunnel Systems, BFS Hotelier and Designblue are brand names, not separate companies. Your agreement and your invoices are with Designblue Philippines Inc.

2. What we sell

The build. A one-time project. Your hotel website with the booking system inside it, your dashboard, your rooms and rates, your guest list and your reports, plus 12 months of managed hosting from launch and a training session at handover. You own it.

The Care Plan. Optional and monthly. Managed hosting and backups from year two onward, the guest AI assistant on your site, the admin AI assistant in your dashboard, channel sync to the booking platforms, live reporting, and technical support during business hours.

Social media content. A separate, optional service. We make the posts, the reels, the captions and the monthly calendar. You approve them and you publish them from your own accounts.

3. What we don't do

1.  We don't build, run or manage ads of any kind, and we never handle your ad spend.

2.  We don't publish on your behalf. You press the button.

3.  We don't shoot photos or video. You supply the raw images.

4.  We don't supply layered or editable source files for social content.

5.  The booking engine sells room-nights. It doesn't handle day passes, cottages, entrance fees, function rooms or tours.

6.  We don't report on marketing results and we don't set marketing targets. The reporting in your dashboard is your own bookings and revenue.

If you need something on this list, ask us. If we can do it well, we'll quote it. If we can't, we'll say so.

4. Prices, VAT and fees

Our prices are on the pricing page, and the ones that apply to you are on your quote.

All prices are exclusive of VAT. It's added at the rate the law requires and shown as its own line on your invoice, so you can always see what's our fee and what's the tax.

We may change the Care Plan price, or pass on a rise in what a third party charges us, by giving you 60 days written notice. If you don't want the new price, you can cancel before it takes effect and pay nothing extra.

Your guests pay you through the online payment platform you choose, named on your quote, in your hotel's own name. That platform charges its own standard processing fee, which is theirs and not ours. We don't add anything on top of it and we don't take a share of it. Nobody takes a commission on a booking made on your own site.

Your domain is registered and paid for by you, directly, so it's in your name from the start.

5. What you own

Yours from the start, whatever happens: your domain, your content, your guest data and booking records, and your payment platform account. None of it is ours to hold.

Yours once the build is paid in full: the website, the custom code written for you, and the designs.

One part stays ours: the booking engine framework underneath your site. You get a permanent licence to keep using it as part of your site.

What you own doesn't depend on staying on the Care Plan.

6. Paying, and stopping

The build is paid in two parts, one before we start and one on launch. Your quote states the amounts. Until we confirm to you in writing that work has started, your deposit is refundable. After that it isn't, and if you cancel part way through, the work stays with us and you owe nothing more.

The Care Plan runs for a minimum of three months, then month to month. After that, either of us can stop it at the end of a paid month.

Hosting only is available after your first year, month to month, with 30 days written notice on either side.

Social media content runs for a minimum of six months, then 30 days written notice on either side.

Your service agreement sets out the rest, including what happens if an invoice goes unpaid.

7. What keeps working if you stop the Care Plan

Keeps working: your website, the booking engine on it, your dashboard, your content editor and the reports built into your admin, on hosting that can run them.

Stops: the guest AI assistant, the admin AI assistant, the channel sync to the booking platforms, the reporting that draws on those, technical support, and our managed hosting unless you move to hosting only, which is available after your first year. If you're still inside the 12 months of hosting included in your build, that hosting runs to the end of the 12 months whatever happens to the Care Plan. You've already paid for it.

You export your own booking and guest records from your dashboard whenever you like, for as long as your site is hosted with us. We keep that working. We don't run exports for you, so export on a regular schedule rather than waiting for your last day. If you leave us entirely, your site stays live on our hosting for 30 days after your last paid day, and we keep your data for 60 days from the day your services end and then delete it, keeping only what the law requires us to keep. If your site is already offline and you still need your records inside those 60 days, ask us in writing and we'll send you a copy of your database.

If you move your site elsewhere, we hand over the code, the uploaded files and a copy of your database, along with the setup notes and the technical requirements your new hosting has to meet, once your build is paid in full. Moving it for you is a separate paid service, quoted before we start.

8. Support

Monday to Friday, 9am to 6pm Philippine time, excluding Philippine public holidays. Support is part of the Care Plan, on Viber and WhatsApp. Outside those hours we don't commit to a response.

Support covers bugs and faults in what we built, hosting problems, reconnecting the channel sync when it drops, and questions about using your dashboard and content editor. New pages, new features and redesigns are quoted separately, and problems inside your own OTA or payment platform accounts are for you to raise with them.

9. Your guests' data

Your guests' data belongs to your guests, and you're the one responsible for it. We hold it only to run the services you're paying for, and only on your instructions. We don't sell it, we don't share it with other clients, and we don't use it to train anything.

How we hold it, how long we keep it, who can see it and what we do if something goes wrong are set out in our Privacy Policy.

10. Things outside our control

Your service depends on other companies: the channel manager that carries your booking platform sync, the payment platform you choose, an AI provider and our hosting provider. We choose them carefully and we manage them for you, and we don't own them. If one of them has an outage, changes its rules or stops offering a service, we'll tell you promptly, work around it where we can, and help you move to an alternative. We can't promise their uptime as if it were ours, and we aren't responsible when one of them fails.

The same goes for events beyond anyone's control, such as typhoons, floods, earthquakes, power and internet failures, government action and civil disturbance.

11. Working with other hotels

We don't offer territorial exclusivity. We may work with other hotels and resorts, including ones near you and ones you compete with. We'd rather tell you that plainly at the start than have you find out later.

What we commit to instead is that your rates, your bookings, your occupancy, your revenue and your guest data are never shared with another client, and never published, quoted or referenced in our marketing without your written permission. That continues after you leave.

We may show your website in our portfolio as an example of our work. That's the design and the build only. Your numbers stay out of it.

12. Which document counts, and which law applies

This page is a summary. Your quote and your signed service agreement carry the full terms, including payment, timings, responsibilities and limits. Where this page and that agreement differ, the agreement wins.

We may update this page as our services change. Updating it doesn't change an agreement you've already signed. If we ever need to change that agreement in a way that has a real effect on you, we'll give you 60 days written notice, and you can cancel instead.

These terms are governed by the laws of the Republic of the Philippines. Disputes go to the courts of Makati City.
